Civil and Criminal Forfeiture


Civil forfeiture is a process in which law enforcement officers or other government agents seize assets (cash, real estate, cars, boats, planes, merchandise) from persons or businesses suspected of involvement with crime or illegal activity without charging the owners of the property with any crime.  While civil litigation generally involves a dispute between two private citizens, civil forfeiture involves a dispute between law enforcement and property that has been suspected of being involved in a crime. To get back the seized property, owners must show that the government did not have the legal right to take and keep the property through the forfeiture process.
